Terms

Last updated

These terms apply to the Glauco desktop app, Glauco licenses, this website and your account. Glauco is made by Koode, postal address Postbus 8830, 1006 JA Amsterdam, the Netherlands, Chamber of Commerce (KvK) 71804005. Questions: support@glauco.app.

1. What a license gives you

Glauco is licensed, not sold. While your license is active, you may install and use Glauco within the limits of your plan:

  • Personal: one natural person, on up to 3 installs.
  • Team: one seat per person, at least 3 seats, and up to 3 installs per seat. The buyer is the team admin and manages seats and installs in the account.
  • Enterprise: as agreed in a written contract. It can include offline activation with license files that are valid for one year and bound to one computer.

A Personal license and each Team seat belong to one natural person. Its installs are for that person only and may not be shared with other people, also not through a shared computer, user account or remote desktop. Every person who uses Glauco needs their own license or seat. A team admin may move a seat to another person, for example when someone leaves the team.

You may not share a key beyond these limits, resell or sublicense Glauco, get around its license checks, or reverse engineer it, except where the law allows this.

2. Trial and free mode

Every new install can use every feature for 14 days without a key. You may use the trial for any purpose, including to evaluate Glauco at work.

After the trial, or when a license ends, Glauco works in free mode: one cluster, read-only. Free mode needs no key and is for personal, non-commercial use only.

Commercial use is any use for work: as an employee, contractor or freelancer, or for a company or other organisation. After the trial, commercial use needs a Personal, Team or Enterprise license. Learning, study, hobby projects and unpaid open-source work are personal use.

We may change what the trial and free mode include.

3. Buying, renewing and cancelling

  • Personal and Team are yearly subscriptions. You buy them through Stripe. Sold through Link, LLC, a Stripe company, is the merchant of record, shown at checkout as "Link": it sells the subscription to you under the Link terms.
  • Prices are on the pricing page. Euro prices include VAT. US dollar prices exclude sales tax, which is added at checkout where it applies.
  • A subscription renews every year until you cancel it.
  • You can cancel at any time in your account, under "Manage billing", which opens the Stripe customer portal. The license stays active until the end of the year you paid for.
  • Refunds follow Link's refund policy. If you are a consumer in the European Union, you have a 14-day right of withdrawal, which the merchant of record handles under its terms.
  • Enterprise is invoiced by Koode under its own contract. Ask sales@glauco.app.

4. License checks

Glauco checks its license with our server once a day while it is online. If it cannot reach the server, it keeps working for up to 30 days after its last successful check. After that, it works in free mode until a check succeeds again. A seat or install that a team admin removes, or a license that ends, stops working at its next check. An offline license file for an air-gapped computer is never checked online and stops working on its end date.

5. Acceptable use

  • Use Glauco only on clusters you are allowed to access, and only in ways the law allows.
  • Do not attack, overload or probe our servers, and do not try to get around license limits.
  • Sign in to the account only with your own email address.

We may suspend a license or account that breaks these rules.

6. Your clusters

Glauco works with your clusters using your own credentials. You are responsible for the changes you make. Glauco asks you to confirm every change, but it cannot stop a change you confirm.

7. No warranty

Glauco is provided as it is. We do our best to make it reliable, but we do not promise that it is free of errors or that it fits your purpose, except where Dutch law does not allow us to exclude this.

8. Liability

As far as the law allows, our total liability is limited to the amount you paid for Glauco in the 12 months before the event that caused the damage. We are not liable for indirect damage, such as lost profit, lost data or damage to your clusters. This does not limit liability for intent or deliberate recklessness, or any liability the law does not allow us to limit.

9. The website and your account

The account at glauco.app/account is for managing your licenses. Keep access to your email address safe: anyone who can read your email can sign in. How we handle personal data is in the privacy policy. For a paid license bought by a company or other organisation, the Data Processing Agreement is part of these terms: it covers the personal data of your team that we process for you.

10. Changes to these terms

We may change these terms. We publish changes on this page. For a change that matters to a running subscription, we tell the license holder by email at least 30 days before it applies. If you do not agree, you can cancel before that date.

11. Law and disputes

Dutch law applies. Disputes go to the competent court in Amsterdam, unless the law gives you, as a consumer, the right to go to another court.
